Parents are obligated to raise their children who are under the age of 18 years or cannot live independently due to accidents or other reasons not attributable to such children.
But in fact, many parents refuse to perform their obligations to raise their children or pay child maintenance. If this happens, such a child may have the following options.
1. Where both parents refuse to perform their obligations to raise the child, the child or the police may file a criminal case to impose criminal penalties on their parents if adverse consequences occur due to their abandonment. In practice, such adverse consequences may include but are not limited to death, severe injury, suicide, extreme difficulties, or other severe sufferings of the child.
2. Where the child does not hope that his/her parents will be subject to criminal penalties, he/she may file a civil case to claim child maintenance from his/her parents. With the money paid by his/her parents, the child may choose to live independently, or if he is too young to live independently, he/she may enter into a custody agreement with a relative, neighbor, villagers’ committee, residents’ committee, or any other individual or entity who/that is willing to take over the custody of the child, with or without a consideration.
