Contributions of a spouse to their family life, such as in raising their children, caring for the elderly, assisting the other spouse in work, etc., are important considerations in property division if their marriage ends up in divorce. The spouse who has made more contributions is entitled to a larger portion of their community property and the other spouse should make reasonable compensation.
The spouses may specify a specific proportion or amount to which the spouse who has made more contributions is entitled if the spouses reach a divorce agreement, failing which the spouse is entitled to claim a larger portion in a divorce lawsuit.
If community debts are involved, the spouse who has made more contributions should bear a smaller portion or be exempted from their community debts.
Such provisions and practices are based on the policy to protect women in marriage and divorce as women are generally placed in a vulnerable and disadvantaged position.
