If your marriage is likely to end up in divorce and you are worried that your spouse will conceal, transfer, destroy, or squander your community property, you may file a petition to request the court to preserve such community property by freezing, seizure, or other measures to prevent damage and loss before or when you file a divorce case.
The court will order that the petitioner pay a specified amount as security, considering the value of the property to be preserved, the loss that may be incurred due to preservation measures, and other relevant factors.
If the other spouse against whom the preservation measures will be taken pays the amount specified by the court as security, the preservation measures will not be taken or will be cancelled, as the case may be.
Any security amount will be refunded unless the payer fails to perform their obligations under the decree, consent decree, or settlement agreement.
