Claim for Property Division during Marriage Not Sustainable

Except in a divorce case, husband or wife may not file a case for the division of their community property unless:
1. the defendant conceals, transfers, sells, destroys, squanders, or otherwise cause damage to their community property, or falsifies community debts, which causes or may cause material damage to the interests of the plaintiff; or
2. the plaintiff or other person whom the plaintiff has an obligation to support suffers from a major disease and needs medical treatment, but the defendant refuses to bear the medical costs.
Other than the above circumstances, if husband and wife intend to divide their community property, they may enter into a written agreement rather than go to the court.
