Can You Claim Revocation of Your Property Division Agreement after Divorce
 
If a couple divorce each other by agreement, through mediation, or by a court decree or consent decree after reaching a property division agreement for the disposal of their community property and debts, such an agreement becomes effective and binding after their divorce.
 
If either spouse intends to revoke such an agreement after their divorce, he/she may file a lawsuit requesting the court to revoke the agreement. After admitting the case, the court will review the case to find out whether the agreement was entered into under coercion or in fraud.
 
The agreement will be revoked only if the court finds sufficient evidence of coercion or fraud. Otherwise, the claim for revoking the agreement will be dismissed.
