Child Born out of Artificial Insemination
Husband and wife may agree to have children by artificial insemination during their marriage. And according to the Civil Code and the SPC’s Interpretations Pertaining to the Application of Title Five "Marriage and Family" of the Civil Code of the People's Republic of China (I), a child born out of artificial insemination has the same legal rights and legal status as a child born in wedlock.
In such a case, neither husband nor wife may claim nonexistence of parent-child relationship by conducting a DNA paternity or maternity test. And both parents have custody over the child, and shall raise, educate, support, and protect the child.
If either parent fails to perform his/her obligations to the child as a parent, he/she may be held civilly or even criminally liable according to law.
