Compulsory Measures in Exercising Visitation Rights
Compulsory Measures in Exercising Visitation Rights
A parent who does not serve as guardian of their minor child have the right to visit such child, and the other parent who serves as the guardian of such child or other organization that is responsible for taking care of the child, whether the child’s guardian or not, should provide reasonable assistance in the visitation.
If the guardian refuses to assist in the visitation, or impedes, hinders, or otherwise prevents such visitation, the visiting parent may request the court to take compulsory measures against the guardian or other organization. Such compulsory measures include detention and/or fines.
Provided, however, that no compulsory measures may be taken against the person of the child, which means that the court cannot force the child to be visited.
