Custody of a Step-child after Divorce

Custody of a Step-child after Divorce

Where a child's biological parent and step-parent divorce each other, they may reach an agreement on who will have the custody of the child after their divorce. But if the child has attained to the age of eight years, the choice of the child should be given priority.

If the step-parent is unwilling to exercise custody of the child who is his/her step-child, the child’s biological parent is obligated to exercise custody of the child after their divorce.

After their divorce, the step-parent is not obligated to pay child maintenance for the child, which shall be paid by the biological parent who is not exercising custody of and living with the child.
