Considerations in Granting Child Custody
 
If man and wife fail to reach an agreement on the custody of their children, their dispute must be adjudicated in court. In a case for child custody, the following factors will be considered when a judge decides which parent should be granted child custody according to The Civil Code of the People’s Republic of China and the SPC's Interpretations Pertaining to the Application of Title Five "Marriage and Family" of The Civil Code of the People's Republic of China (I) and based on practical experience:
1. Financial background and income;
2. Educational background and profession;
3. Personality and character traits;
4. Whether they have been imposed criminal penalties;
5. Whether they have been suffering from incurable infectious diseases or other major diseases;
6. Whether they have been sterilized or become infertile;
7. Whether they have other children;
8. Whether they have been living with the children for a long period of time;
9. Whether they (including their parents who are willing to assist them in raising children) have the time and energy to raise children; and
10. Other consideration that may have an impact on child custody and support.
